1. Agreement to Terms
These Terms and Conditions ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and Nomado, LLC ("Company," "we," "us," or "our") governing your access to and use of our website, mobile application, eSIM services, and related services (collectively, the "Services").
By accessing, registering for, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, including our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must immediately cease using our Services.
We reserve the right to modify these Terms at any time. Your continued use of the Services following any changes constitutes acceptance of those changes.
2. Eligibility and Account Registration
2.1 Eligibility Requirements
To use our Services, you must:
- Be at least 18 years of age or the age of majority in your jurisdiction
- Have the legal capacity to enter into a binding contract
- Not be prohibited from using the Services under applicable laws
- Possess a compatible eSIM-enabled device that is carrier-unlocked
- Reside in a country where we are authorized to provide Services
2.2 Account Creation and Security
When creating an account, you agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the confidentiality and security of your login credentials
- Accept full responsibility for all activities conducted under your account
- Notify us immediately of any unauthorized access or security breach
- Not share your account with any third party
- Not create multiple accounts for the same individual
You are solely responsible for any losses or damages arising from your failure to maintain account security. We reserve the right to suspend or terminate accounts that violate these security requirements.
3. Service Description and Scope
Nomado, LLC provides digital telecommunications services enabling mobile connectivity through embedded SIM (eSIM) technology. Our Services include:
3.1 Core Services
- Purchase and digital delivery of eSIM profiles
- Activation and provisioning of mobile data services
- Access to mobile data networks in supported countries and regions
- Account management portal and mobile application
- Customer support through designated channels
- Data plan selection, purchase, and modification capabilities
3.2 Service Limitations
The Services are subject to the following limitations:
- eSIM profiles are data-only and do not include voice calling or SMS capabilities unless explicitly stated
- Service availability depends on local network operator infrastructure and coverage
- Network speeds are not guaranteed and may vary based on location, network congestion, and other factors
- We do not provide telecommunications services directly but act as a reseller of mobile network operator services
4. Pricing, Payment, and Billing
4.1 Pricing and Fees
- All prices are displayed in United States Dollars (USD) unless otherwise specified
- Prices are subject to change at any time without prior notice
- The price at the time of purchase will apply to your transaction
- Advertised prices exclude applicable taxes, duties, or governmental fees, which will be added at checkout
- Promotional prices and discounts are subject to specific terms and conditions
4.2 Payment Terms
- Full payment is required before eSIM profile delivery and service activation
- We accept major credit cards, debit cards, and other payment methods as indicated on our platform
- By providing payment information, you represent that you are authorized to use the payment method
- You authorize us to charge your payment method for all applicable fees and charges
- Payment processing is handled by third-party payment processors subject to their terms
- Failed or declined payments may result in service suspension or termination
4.3 Billing and Invoices
Upon successful payment, you will receive an electronic invoice via email. It is your responsibility to review all charges and report any discrepancies within 30 days. Failure to object within this period constitutes acceptance of all charges.
5. Data Plans and Usage Policies
5.1 Plan Specifications
- Each data plan has a specified data allowance and validity period clearly stated at purchase
- Data plans commence upon activation, not upon purchase
- Validity periods cannot be paused, extended, or transferred unless explicitly offered
- Unused data does not carry over or roll over to subsequent periods unless explicitly stated
- Once a plan expires, any remaining data allowance is forfeited
- Top-up or add-on data purchases are subject to the same terms as the base plan
5.2 Fair Usage Policy
To ensure quality service for all users, we implement fair usage policies:
- Excessive data usage may result in speed throttling or service suspension
- Plans marketed as "unlimited" are subject to fair usage thresholds disclosed in plan details
- Network operators may implement their own traffic management policies
- Use of Services for commercial purposes, resale, or redistribution is prohibited
5.3 Network Performance
- Network speeds and quality of service depend on local network operator infrastructure
- Advertised speeds represent maximum theoretical speeds and are not guaranteed
- Network coverage and performance may vary by location, time, and network congestion
- We make no warranties regarding network speed, latency, or uptime
6. Device Compatibility and Technical Requirements
You are solely responsible for ensuring your device meets all technical requirements:
- Your device must be eSIM-compatible and support the required eSIM technology standards
- Your device must be carrier-unlocked and not restricted to a specific network operator
- Your device must have a stable internet connection for initial eSIM profile download
- Certain devices may have limitations on the number of eSIM profiles that can be stored
- You must follow manufacturer instructions for eSIM profile installation and activation
We are not liable for any inability to use our Services due to device incompatibility, device lock status, software limitations, or user error in installation. No refunds will be issued for device compatibility issues.
7. Prohibited Conduct and Acceptable Use
You agree to use our Services only for lawful purposes and in accordance with these Terms. You expressly agree NOT to:
7.1 Prohibited Activities
- Engage in any illegal activities or violate any applicable laws or regulations
- Share, transfer, or resell your eSIM profile or account credentials to unauthorized parties
- Use the Services for commercial resale, redistribution, or unauthorized business purposes
- Attempt to reverse engineer, decompile, or extract source code from our software
- Gain or attempt to gain unauthorized access to our systems, networks, or databases
- Interfere with, disrupt, or compromise the integrity of our Services or infrastructure
- Transmit viruses, malware, or other harmful code through our Services
- Use automated systems (bots, scrapers) to access our Services without authorization
- Engage in spamming, phishing, or other fraudulent activities
- Harvest or collect user data without proper authorization
- Impersonate any person or entity or misrepresent your affiliation
- Use the Services to infringe upon intellectual property rights of others
7.2 Network Abuse
- Excessive bandwidth consumption that degrades network performance for other users
- Running servers, torrenting, or peer-to-peer file sharing (unless explicitly permitted)
- Operating network-intensive applications that violate fair usage policies
- Circumventing network restrictions or security measures
Violation of these prohibitions may result in immediate suspension or termination of your account, forfeiture of any remaining service credits, and potential legal action.
8. Refund and Cancellation Policy
8.1 General Refund Policy
Due to the digital nature of our Services, all sales are generally final. However, refunds may be considered at our sole discretion in the following circumstances:
- Service is unavailable or non-functional in the advertised coverage regions
- Technical issues on our end prevent eSIM profile download or activation
- Duplicate purchases or billing errors attributable to our systems
- Failure to deliver the eSIM profile within a reasonable timeframe
8.2 Refund Exclusions
Refunds will NOT be provided for:
- Device compatibility issues or locked devices
- User error during installation or activation
- Network performance issues caused by local operators
- Coverage gaps or network unavailability in specific locations
- Partially used or activated eSIM profiles
- Change of travel plans or non-use of the Service
- Third-party payment processor fees or currency conversion charges
8.3 Refund Process
To request a refund, you must contact our customer support within 7 days of purchase. Refund requests must include your order number, detailed explanation of the issue, and supporting documentation. Approved refunds will be processed to the original payment method within 7-14 business days.
9. Service Availability and Modifications
9.1 Service Availability
While we strive to provide reliable and uninterrupted service, we do not guarantee:
- Continuous, uninterrupted, or error-free access to our Services
- That our Services will be available at all times or in all locations
- Specific network coverage, data speeds, or quality of service
- Compatibility with all devices or operating systems
- That defects will be corrected within a specific timeframe
9.2 Service Modifications and Discontinuation
We reserve the right, at our sole discretion, to:
- Modify, suspend, or discontinue any aspect of the Services at any time
- Change pricing, data plans, or service offerings without prior notice
- Remove, add, or modify features or functionality
- Conduct scheduled or emergency maintenance that may cause service interruptions
9.3 Third-Party Dependencies
Our Services depend on third-party mobile network operators and telecommunications infrastructure. We are not responsible for disruptions, coverage gaps, or performance issues caused by third-party providers.
10. Warranties and Disclaimers
10.1 Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties regarding accuracy, reliability, or completeness of service information
- Warranties that the Services will meet your requirements or expectations
- Warranties that the Services will be uninterrupted, secure, or error-free
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- NOMADO, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES
- THIS INCLUDES BUT IS NOT LIMITED TO: LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
- OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM
- WE ARE NOT LIABLE FOR DAMAGES ARISING FROM: SERVICE INTERRUPTIONS, NETWORK FAILURES, DEVICE INCOMPATIBILITY, DATA LOSS, OR THIRD-PARTY ACTIONS
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
12. Intellectual Property Rights
12.1 Our Intellectual Property
All content, features, technology, and functionality of our Services, including but not limited to:
- Text, graphics, logos, images, audio, video, and software
- The compilation, organization, and presentation of content
- Trademarks, service marks, and trade names
- Source code, object code, and underlying technology
are owned by or licensed to Nomado, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
12.2 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use our Services solely for their intended purpose. This license does not permit you to:
- Reproduce, distribute, or publicly display any content from our Services
- Modify, adapt, or create derivative works
- Decompile, reverse engineer, or attempt to extract source code
- Remove or alter any copyright, trademark, or proprietary notices
13. Account Suspension and Termination
13.1 Termination by You
You may terminate your account at any time by contacting customer support. Termination does not entitle you to a refund for any purchased services or unused data allowances.
13.2 Termination by Us
We reserve the right to suspend or terminate your account and access to our Services, with or without notice, for any reason, including but not limited to:
- Violation of these Terms or our policies
- Fraudulent, abusive, or illegal activity
- Non-payment or chargebacks
- Providing false or misleading information
- Conduct harmful to other users, our business, or third parties
- Extended periods of inactivity
13.3 Effects of Termination
Upon termination:
- Your right to access and use the Services will immediately cease
- Active eSIM profiles may be deactivated
- We may delete your account data subject to our data retention policies
- Sections of these Terms that by their nature should survive termination will remain in effect
14. Indemnification
You agree to indemnify, defend, and hold harmless Nomado, LLC, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use or misuse of the Services
- Your violation of these Terms
- Your violation of any rights of another party
- Your violation of applicable laws or regulations
- Any content or data you submit through the Services
15. Dispute Resolution
15.1 Informal Resolution
Before initiating formal proceedings, you agree to contact us and attempt to resolve any dispute informally by sending written notice to our support team. We will attempt to resolve the dispute through good-faith negotiations within 30 days.
15.2 Arbitration Agreement
If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration rather than in court, except that either party may bring claims in small claims court if they qualify. The arbitration shall be conducted in accordance with the rules of a recognized arbitration organization.
15.3 Class Action Waiver
You agree that disputes will be resolved on an individual basis only, and not as a class action, consolidated action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms without restriction.
17.5 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemics, labor disputes, or government actions.
18. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last updated" date at the top of these Terms
- Notify you via email or through a prominent notice on our Services
- Provide you with a reasonable opportunity to review the changes
Your continued use of our Services following any changes constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using our Services.
